I had this experience in the past...when my H1 Extension is applied sometime back, they gave me a new i-94 number (probably due to an error)....however, when I left the country for a vacation, I stapled & returned both I-94's as per my attorney's suggestion (through my emp)...

because I had submitted all my w2s and tax stuff when i filed concurrently last year on aug 7 2007
Lawyer sent it on Oct 28 and recvd on nov 3..then in 2 days approval..

Hi,
My current visa status is H4. As i cannot work on this visa, I am interested in doing an Unpaid Internship. Please clarify whether I can do so on an H4 visa.
I'm trying to secure the internship in a nonprofit organisation. Will there be an exception for them, in case it's not allowed otherwise?

AFAIK, you can do volunteer work without restrictions, provided this truly is a volunteer work; i.e., there is no employer-employee relationship, and you are not working in anticipation that you will be hired in near future based on your current work.
Maybe a good test is, if the nonprofit organization requires your SSN before they would allow you to work, then you may not do that work on H4.

The Priority Date box on I-140 shows the priority date alright. But the one on I-1485 is blank. Please can any one check their I-485s and let know if you are also in the same situation?

1..I would like to know if an employer revokes 140, and if the AC21 is not submitted at the time of NOID...how many days are given by USCIS?
Is it 30 days?
2..If I go to another emplyer and try to do interfile, still I need to file AC21?
And if the new category is EB2(my old application is EB3), still is that ok?
For eg..EB3 title is system analyst, and if I want to go for Eb2 then which could be more apprepriate..?Senior SYSTEM ANALYST

I am applying for MBA program in american sentinel university.
I want to know if I am eligible to apply for H1B in master's quota after I graduate from this univ. American sentinel university has Institutional Accreditation by the Distance Education and Training Council (DETC). Please help me in this regards.
Today I called USCIS and they said that they cannot tell anything and only service centers take decision on the case.

I heard that now all we are getting 2 Year EAD/ AP for renewals. Thats very good news to us. I have couple of questions on this.
1. How do we need to pay for renewal? Fee will be 2 years fee or 1 year fee?
2. Is this one combined document with EAD/AP?
3. Is this process already started?

Dont worry too much. Get your H1 extension with current employer even if it s a consultancy firm when you are on project. It wont be deied.

I came across a posting today for a local contract position, which was a good match for my profile. But when I sent my resume in, the vendor said we cannot proceed because the end client asked for either citizens or GCs. I thought it was strange, because it is a contract requirement, not fulltime. This is the first time that I have encountered someone requiring a GC for a contract posiiton. Further, this is not a defence or state department kind of deal where you'd need citizens. I would understand if they said 'citizens only', but GC or citizen does strike me as unconventional.
Can someone please advise if this is allowed by law?
Yes it is legal. They are merely giving preference to citizens and permanent residents, and it is line with the department of labor regulations. They cant however discriminate between H1-B from different nationalities.
Also, they might have a project stipulation where they do not want any uncertainity as to how long they can keep the contractor.

Please advise:
I am on F-1 and working under CPT from Jan 07 to Aug. 07 and will extend CPT from Sept 07 to Dec. 07.
I applied I-485 and 765 (EAD) as a husband on my wife's LC on July 2, 2007.
I will not be getting my EAD before Sept. 07.
My confusion is whether is it legal to extend my CPT on F1 even if I receive AOS receipt number ??

There are two sides to the issue : strengthening the domestic workforce through education, research investment etc and then there is skilled immigration. The first half no doubt enjoys unanimous support ... however, when it comes to promoting skilled immigration, it is a pretty safe bet that the anti-immigrant lobby is going to play hard ball (already evident from the SF gate article). The only benefit of F1 over H4 is you get to use OPT and CPT. Doing an internship may be very beneficial if you are doing a MBA. After that OPT helps you to settle in a job and deal with H1B filing quota risks.
Regarding the downside of F1, many universities don't give instate tuition eligibility to students on F1. On H-4, you may pay instate tuition to many universities. So, check with the university that you are planning to attend.
Also, it will be very difficult to get a F1 visa stamp on your passport if I140 has been filed for you in the past. Its not a problem if you don't want to travel outside the country during your studies.
