He is undoubtedly a populist (he used to be a sycophant earlier ... remember the earlier days on CNN ?), the man is cheap no doubt. He is a nativist, who claims immunity to such charges laid upon him. He never mentions that he is married to a hispanic american lady - well that is a deliberate attempt at cover.
Guess what the " hard core republican ", corporate CEO loving, capitalist champion is now the warrior for the middle class and a critic of the current administration.
Can you actually believe this guy?
I dislike his show, i do not rescept his perspective (because it is mostly based on incorrect or false information) and i sincerely believe that he is a worthless parrot.

After we reported this news, we learned that there were some readers who gravely misunderstood the "final" rule making process. They were confused with the "proposed" rule making process. In the final rule making process, there is no comment period before the rule takes effect. On the date when the final rule is published in the federal register, it becomes a binding rule and the rule-making process is complete. Certain provisions in the final rule may take effect on certain specific later date or dates, but the rule itself becomes a binding law on the date of publication of the rule in the federal register. Accordingly, unless the DOL changed the proposed rule, substitution of the beneficiary of the labor certification will be eliminated on the date of publication which includes the substitution of the beneficiary in the pending labor certification by amendment as well as the substitution of the beneficiary in the approved labor certification. For those who filed the substitution I-140 petition, the proposed rule provided that only "substitution approved" on the date of publication of the rule would survive. Substitution approved can be interpreted to mean approval of the substitution I-140 petition. OK, coming to the point, how did you open 2nd SR within a week. Did you get any response for the 1st SR or 2nd SR at all? If so, what was it?

You guys are not getting it. No (in like None, Nada, zilch etc.) insurance covers pre-existing condition for visitors. If a complication arises, and you had to use the insurance, the question will be if it is a pre-existing condition or something that came up after coming here. Even if the condition comes up where an incident is not related to pre-existing condition but aggravated due to pre-existing condition, insurance will cover minimal claim amount. The odds are rigged up against you no matter what. Put yourself in the insurance companies shoes. The less you pay the more you make so you always try to deny the claim.
Saying this, you are betteroff buying a American Insurance as hospitals over here see it as something they can count on for being paid back (though law says they have to give the topmost care irrespective of the patients ability to repay). Indian insurance is useless and will be looked down by medical personnel (some of the private pracitioners won't even accept it). Just buy some American Insurance and pray you don't have to use it.

Don't bet on this too much. Not being pessimistic, but in a democracy it is not just what is done but who does it and how it is done. Why should Republicans in the outgoing Congress vote again on a bill when their majority status is obsolete now? Do you think democrats will allow this outgoing congress to take the credit? they are politicians too, anything crappy in that bill is going to be the new Congress's (read Democrat's) burden. Already, a bombshell is waiting in the form of a hastily passed by the house_hastily signed by teh President bill: there is a fine print that removes oversight of how money is spent in Iraq (at least some of it). So, there may even be review of hastily passed, pre-election bills. anything more like this is going to give this congress very very bad name and the next congress a really bad headache.

CIR is difficult due to political landscape. piecemeal approach has the
most likelihood of success especially it is attached to FB category.
On the downside, such bill are tabled every year and they die a natural death.
Visa recapture might since 1992 might greatly reduce the backlog.

I like majority of others who came here on H1 with genunine intent of settling down should work toward common goal of easier GC processing and not support outsourcing idiots esp L1s who is nothing but shipping jobs overseas and making a field (eg IT) minimum wage pay. Just look around how much TCS pay .
COmmon goal of us is easier and humane green card processing and to work towards the goal to stop blatant abuses in the form of L1 (and some H1 )

I agree with your opinion however we might be in the minority here, fellow members(some of them) are just concerned about getting an EAD and AP. They do now know the issues we face after that. Every year renewals, associated risk of not getting AP in time to travel out and not to metion that fact that this will definitely add to the waiting period indefinitely again unless we get together and initiate a campaign for
1. Recapturing unused visa numbers from past years
2. Getting USCIS to treat Primary + Derivatives as one Visa number rather than individual.

How about they don't count dependent children under maybe 14 to the annual quota. They don't need EADs and they will not compete for jobs with anyone for a long time.

I received a sms saying that my case status has been updated (weird they sent it @ 9:25 pm PT). I was like here comes another biometrics appointment... but still let's check the status online. To my surprise and by god's grace, case status was changed to "Card/Document Production" (still cannot believe it). I dunno what triggered this but i did contact my Congressman yesterday. My wife's status has also changed to "decision" - should move to "Card production" soon.
My suggestion to all of you - please don't lose patience and do whatever you can from your end to expedite your case. It's your GC and you've to make sure you get it. Contact I/O, infopass and congressman/senator. Don't expect anything from your lawyers as they only care about money and it is in their best interest to see your case pending (more RFEs, EADs, APs, etc).
Thanks and all the best to all of you out there still waiting for your GC.

When you call the law makers and tell them you support XYZ bill.. my question is what do you get out of it!
When the lawmaker realizes that he is getting 10000 calls from LEGAL aliens,
>who are not from his constituency,
>who can�t vote and
>who can�t contribute to his election campaign�
what is the motivation for the law maker to support the bill�
So to avoid sounding stupid and foolish and desperate when you call� a more logical approach would be to :
a) Generate a public petition form on IV website and have all the members� login and sign the forms digitally�
b) Then have IV reps.. fax them and send them to lobby groups �.
c) Lawmakers will listen to one talking head�and not worry abt 1000 calls that borders on ..�saar �support the bill saar�..
How many of you have actually talked to the lawmakers? Its always the assistant!
But instead .. someone says we have a signed petition of 25000 members effected by immigration mess �. And it�s a hi tech workers lobby group ..every lawmaker will talk to you and not the assistant!
Conclusion: calling the lawmakers haphazardly is actually hurting IV cause..to a certain extent!

Good post I like it and I probably may follow most of these eventually but, if I think about it, it seems to me lot of stress. Maintaining records from past ten (GC)/fifteen (Citizenship) years is certainly a stressful activity. Except education certificates I never cared for anything in my home country. In spite of taking care of all this, if you get involved in an unfortunate event everything GC/Citizenship goes into vain and back to square one.
I am not trying to discourage or depress any one. It�s just a thought.

Instead, if I begin to get organized early, the process eventually becomes incremental and stress-free. On the other hand, it appears that there is an advantage to switching to EAD prior to the 6 year H1 expiration to stop the H1 clock. In situation where a AOS is incorrectly denied, a change of status from EAD to H1 for the remainig time can be helpful.
