Hi All,
You know my old H1B case was reopened on Sept. 28, and the USCIS Emailed me that they sent a notice. But I haven't received such notice, my employer/attorney also didn't receive any notice. I wonder the USCIS didn't send this notice at all!

Post doc is a position not a US educational qualification and hence not a benefitiary of SKIL bill. The SKIL bill included US Master's and Ph.D's.
With your US MS you should not have any problem. Would require 3 years work experience to allow one to self adjust. We will need to wait and see what happens when it is introduced again in the new congress.
I hope USCIS has your thought process. Your thought process means that there is something in SKILL for US MS. I used to think that SKILL is only for non US MS.

2. with diff. employer, would I get 3 years or just six months, or not at all?
With different employer, you can get 3 years as well, if the new employer has filed for a new PERM and you have received an approved I-140.

Honestly, these consultants don't even have an H1B worthy job: its not a permanent job offer. They don't get paid fulltime. Let alone their eligibility for a GC ....what a scam!

wife's SR yielded in a response of "assigned to an officer on 9/11" and my infopass today (9/15) also had the same result....so I guess its a waiting game for us! I tried normal "outside of processing window" method to file SRs but now learnt about getting to directly to talk to IO...will try that tomorrow - I wish I could bug them ay this hour :)

USCIS cannot keep the filing fees if they return your application. They can only keep it if they do accept it and then deny/reject your application.
If PD is not current, they cannot accept the application, the just have to return the applications citing the same reason. If they accept the application they have to receipt it and if they reject, then they need to have qualified reasons for it... Not having available visas is not an acceptable reason to reject the receipted applications. It goes to shelves untill visa number becomes available... Note. if they receipt, they need to process EAD/AP and work on the application like any other.
This is my understanding..

I think this is good news, but I am not sure if this will affect me. I have PERM approved labor on my name. I didn't apply for I-140 because I wanted my wife to get F1 visa before doing that. This is because F1 application for my wife can have problem if there is immigration petition and she is beneficiary. I don't know how much time its going to take me to get greencard or work authorization for my wife and I want her to get the advantage of OPT after completing her studies so that she can make her career.
So I guess if this rule comes, I have to apply I-140 immediately? Is this true? Please advice me.

Logiclife. I know why you are responding to these comments you all are frustrated with such comments. I know it is hard to not respond but please ignore these asinine comments. Please have some of these comments linked to the main page. But believe me "barking dogs seldom bite." Such people will ultimately sap your energy. But, just like how IV is asking people to contribute please also ask them to use their own judgment, they do this at their own risk. There are many people like us who have faith in your group although we know you cannot do miracles. Please have faith and I sincerely request to all members & moderator that once we see these comments let us move this to the some thread called “IV bashing thread” and let the rest of us completely ignore them.

Many in IV will know that I have never opposed legal porting. However, I disagree that this is a way to get out of the mess. There is a fixed total number of Visa available. Per current rule this first comes to EB2 and is consumed completely leaving nothing for EB 3. If all (or majority) EB 3 moves to EB 2, the chocking will be in EB2 . So the "mess" just shifts its position.
The true way is -- 1) Recapture, 2) Exclude dependents from Visa Number
As I see it, the only persons benefited are the ones having the priority dates in ancient times. I think we really should not mind letting them have their GC's, being our seniors.
Yes, later year porters might end up having to wait. It's all in the game, fortunately or unfortunately. One thing is for sure, we as a whole, have an uphill battle
If it really comes to matter, I think it should be easy for an EB2 to port to EB3 if the dates are current for him in the different category. So if I were EB2 today, I wouldn't be so apprehensive :)

thanks for explaining. my suggestion then is to go to school on F1 (maybe ?) and get a degree that can help him/her get a job that qualifies under H1b.

It's oxymoronic to hear a self-confessed slave lecture us on 'Freedom'. Real freedom is standing and fighting for ones rights, and not hiding in a cave. How would a slave know?
'Red Dots' are also Free speech. Members who gave you one also used their 'Freedom of Expression' just like you ( did you think all freedoms are reserved for you ?).
