I am currently working on H1B and have received my EAD and Advance Parole recently. I am planning to travel next month and want to use
my Advance Parole for this purpose. When I come back (to avoid h1b stamping again in home country). Do I need to use EAD to continue
working in US?

I had the same problem with my PERM. my last name had an extra letter in the end at one place but was fine at the other place. My perm was approved without any issues.
At I-140 stage my lawyer made a note of this to USCIS and now my I-140 was also approved without any issues.
I am pretty sure your audit is not related to that because they have no way to to know your real name! at the labor stage

not necessarily true - for example if you get a B1 or B2 that's valid for 10 years - most likely it will exceed the validity of your passport. in that case when you renew your passport , in order to keepo using the Visa - you need to carry both the old and the new passports. H1B is the same, although for shorter duration (usually 3 years) so the issue does not come up as often. bbut of the visa is unexpired, and the passport is expired you would carry both passports to come in on the visa.

Not been following the dates these days. Would be nice to have this info..
1) How much time does it take for the EAD application to get processed (Texas Service center) for new EAD (not an extn)?
2) How much time does it take for the AP extension to get processed (TSC) if I were to apply for an extension of my old AP today?
Thanks all for your inputs.
I would anticipate EAD to be processed in max of 3 months and AP in 2 months.
Would also add a buffer of 2 weeks (just in case).

I have probably a strange case .In 2007 when all the dates were current my employer filed I-140 & I485 at the same time in EB2 . I have received AP and EAD both according to standard procedure.I have maintained my H1B status. Then after a month or so I have received I-140 rejection due to different job requirement and I am overqualified for the job so my attorney interfiled new I-140 under EB3 without worrying about I 485 thinking since I 140 is denied it should nullify I485 under EB2 . In the mean time USCIS sent me a new I-485 receipt # . I got my I 140 approved in another six months under EB3 and now I have two I 485 receipt numbers as well as two A numbers. Both of the receipts when I checked the status show that it is under initial review. Shall I call USCIS and get rid of the initial I485 which is under EBII . Anyone had this kind of experience??

If you didnt initially use your EAD to work, you should be fine because you have a valid H1B! See my other thread on this matter please.

But present i am not working. So i decided to go for OPT Extension is that possible.

Both Department of Homeland Security agencies have provided their staff and offices with guidance on the applicable legal authorities under the VWP in circumstances such as this.
Persons traveling under a visa should contact the nearest USCIS office and follow the instructions below. While these instructions recommend initiating the process 45 days in advance, USCIS is providing reminder guidance on how to handle such cases until normal flights are scheduled between the U.S. and foreign countries affected by the Icelandic volcanic activity.

I�m in EB2 and My I-140 was approved on March 2009 through Employer A. After which I moved to India and now am back (Nov 2010) with Employer B. My old Employer A has my apporved I-140.
It would be great if I get answer the below my Question:
1. Can I apply for I-485 with my new employer B based on my approved 140?? OR
2. Do I need to go back to my old employer A to apply my I-485. If yes is there any specific time period to go back to my old employer A.

1. Since you are asking the question for applying for I-485 with employer B, I presume that you have not filed for I-485 with employer A. If this is the case then you will have to apply for new labor. Once you have new labor approved, then you will have to apply for I-140. You will be able to maintain the same priority date from the old approved I-140 (please make sure you have a photocopy of approved I-140 from employer A).
Now, if in case you had already filed for I-485 with employer A and the case has been pending for more than 180 days, then you can switch jobs using AC21.
2. I do not personally feel that there is any need to go back to the old employer to file for your I-485.
