Please relax. Thanks for your initiative to put up flyers. It would be nice if you could attend the DC rally in person. :)
If you are unable, please do try to contribute such that someone else can attend the rally.
Lol no I'm relaxed enough...just worked up about the rally. I am attending and did contribute too. Am meeting some others later to put up more flyers. All this did was get me more psyched...no harm done :)

Guys, please send us your stories, we can compile a list of all the stories and pass them on to senators for them to see how US will lose if they do not care about highly skilled immigrants

From february 2004 (expiry date of i-94 card) until april 1994 it looks like you accrued unlawful presence. The unlawful presence stopped when you filed the 485.
The unlawful presence was wiped out when you left and re-entered usa (the 3 year bar didn't kick in because the unlawful presence was less then 180 days).
You will be fine.
Just be truthful that you filed 485 before; you had divorce and all the employers that you worked with. Only thing they can get you on is if you try to embelish or hide things even though they were forgiven when you left and re-entered.
Thanks UnitedNations ! That's what my lawyer said too. In fact he prepared the I-485 packet and is sending it to the USCIS Nebraska center today. In my I-485 packet he has included a rider (part 3, I believe) stating that a I-485 was filed earlier and withdrawn by me and has included evidence documents to that effect.

Guys,
I applied that way. I had to take the letter of completion from the school. Luckily I had a research credit to which I got a grade for and it completed my degree requirements. So I got the letter from the school as my lawyer said that I could not file for H1B Masters cap otherwise.
They had filed me for the 65000 regular cap before but they told me that I could apply for the Masters cap only if I have the letter, I got it from the school.
But there is a catch here. Due to all this I have two different dates on my OPT and H1b for finishing up the requirements and hence my OPT is bound to get rejected I think since it would be saying that I graduate in May and my H1B would say that I finished in April.
Trying to figure out if there is a way to stay here in US without having OPT. or else go back and get the visa stamped.

This is not about illegal immigration, this is bout how sheriff Joe uses the nativist sentiment of Arizona for his own political interest. I have been residing in sheriff Joe's jurisdiction for 5 years now and violent crime has gone up more than 60%. Response time to emergency calls is up drastically, and I have personal experience of that. There are 40,000 felony warrants pending on sheriffs desk, and yet he takes his 50 deputies for so called illegal immigration sweep, which contributes only fraction of a percent to the number of deported illegals from Maricopa County. He has been absolutely successful in creating an anti illegal image that keeps him in his seat for years.

I'm not sure if I'm eligible to apply for Master's quota. I'm done with all my degree requirements and I've scheduled my thesis defence on MAy 20th. Is it still possible that I can apply in Master's quota. I've a letter from my schools which states that I'm done with all my degree requirements and I'll be finishing thesis on May 20th. Is this letter enough to apply for MAsters??
you need a letter from the registrar saying that you will get the diploma dated mm/dd/yyyy - for which i think the thesis should be complete.

My heartiest congratulations to IV and Core. Over the last 2 weeks I found that IV was the most reliable and quickest in giving us information.
I have a question for IV , is there a possibility of increasing annual GC quota or atleast reusing unused Visas from previous years.
Thanks and thanks again for all your work.

Change this title to december06 marathon.
We should have one marathon every month and there will be members willing to contribute $20 every month. By changing the title to december marathon, we would psychologically make people to get ready for every month. This way, we do not have to put effort every time to members think about contributing.
Contributing will become their routine part of thinking and also $20 is not a big deal for our cause.
I am ready for $20.00 every month from now on. THere will be lot of guys like me and the change in title will make it happen by creating this title every month and keeping it on home page/top.

I am of the same opinion. We must make presentations to the Foreign Affairs Dept, Justice Department, Presidential Nominees and the Current President and seek from other larger Indo-American, Indo-Chinese Organizations to highlight our suffering. It does not matter whether we are EB2 or EB3 from India or China. What matters is that this is great injustice. How many members of these departments would accept living like us in a country like USA? Are they ok with living in the uncertainty like we do? Will they accept being in the same pay bracket or at the same job level for 5 or more years and that too is not certain? Can they keep their life on hold particularly in the prime of their youth, the way we do? We must remind them how many documents and how many verifications we have to go through to get to the GC (right from F1 or H1 stage). On top of that when the depts life USCIS which are created to facilitate Immigration, turn their backs on us, what does the US Govt expect from us? What does the US Govt expect us to do when DOS second guesses everything that USCIS does and readjudicates and harasses visa applicants through the consulates (with unending and unaccounted for visa stamping delays)?
I have created a spreadsheet with visa bulletin data for the last one year. Anybody with some sense of justice and fairplay can easily look at the data and say that there is no order and no justice for our plight. I created trend charts for EB1, EB2, EB3 and ROW but these did not get uploaded properly. If somebody wishes to try again and recreate these and some how publish them, these charts could be used to communicate our plight in a very simple manner.

I think we should propose to the administration that in view of this unprecedented chaos in the USCIS, DOS, the Congress (on immigration issue) and by implication our lives, they must delink the GC process from being linked to an employer and to the level/skill level/pay scale the LCA is approved for. By linking the process to sponsoring employer they are promoting indentured labor and by forcing us to file new LCAs/ restart GC process for each promotion, they are just being anti-immigrant and anti-progress.

Yes, Very well said Mr. Singh.
The commentator mentioned that he lives in Omaha (I am not sure if that is Iowa - what Tejvir referred to in his speech - or Nebraska).
Have we initiated contact with Tejvir Singh; is he a member of our forums?

ragz4u,
I acknowledge the specific request from the reporter with regards to speaking with someone who is in the process of GC. I agree that you were doing the right thing.
Why I wrote my thoughts were to expand the scope of story collection, not just related to the above. This can help in our quest, when you present the bunch of stories to the concerned authorities. Lawmakers like Senator Sessions who was again highlighting yesterday in the SJC meeting about exemption of spouses and dependents from the GC numbers. This was so nicely explained by the Harvard Professor, that Sen Sessions could not counter at all. When Harvard Prof mentioned that as long as you have more highly skilled legal workers, it is always positive as it contributes to positive cash flow economically and not negative as compared to the undocumented. I could see Sen Sessions just gasping empty words as he could not retort this. The professors rightly put the perspective of positive economic impact with more highly skilled legal workers against the low skilled illegal workers. Here too they mentioned that if the low skilled illegal workers as they are not have a negative contribution to the economy, but when legalized this would become positive. Sen Sessions could not say anything to this, because there were reputed economists, who had a lot of background research in this area.
Now a days even Lou Dobbs seem to change his language, while being against illegal immigrants he was also against H1B (in the past), now he strongly supports Legal immigration, why? because he understands the positive economic impact a legal immigrant makes to the US economy in light of the massive offshoring and job losses. End of the day it is all a numbers game!
My story was already been mailed to you long back and you have acknowledged receiving.

The Sheriff or his officers are not Wardens. A Warden(the head of a prison) can order it if the inmate has demonstrated a history of assaultive behavior or escaped before. Neither applies. And the restraints have to be the least restrictive, not have both legs and hands shackled.
Dude its apparent that you are a moron.
If you want to selectively read what suits your point of view, thats fine. And resorting to name calling is usually a sign that you have no better counter argument.
